Name Change in Passport and Visa in Old Passport.?

I applied for name change in my passport under TATKAL Scheme and after many followups i was asked to pay some fine for my parents name correction. Application was made in Aug 2010 and In between i had to travel so i traveled with my old name passport and now it has Visa till October 2011. I worried that after me paying the fine i have not received my new passport, is it due to the Open VISA on my old passport.I have not mentioned that my old passport had a VISA since the application was made before i travel. Also they have mentioend that my old passport is now canceld when i latest paid the fine for name correction of my parents.
